Recently, among the Russian-speaking population of the Czech Republic, a rumor spread: foreigners who do not pay for medical insurance or who have fines are allegedly being selected for permanent residence. We decided to find out how things stand in reality.
Photo: European Commission There is no longer a foreigner in the life of the Czech Republic than a day of receiving a permanent residence permit. A visa stuck in a passport marked “Permanent residence” makes life easier for a foreigner born outside the European Union, allows him to work without restrictions and, most importantly, for 10 years to forget the way to the authority responsible for migration issues. The issuance of permanent residence in the Czech Republic is handled by the Ministry of the Interior, it can also take away the issued residence permit. In what cases is this possible, we were explained by the Press Secretary of the Czech Ministry of Internal Affairs, Vladimir Rzepka.
– Is the permanent residence renewed after the expiration of a ten-year term automatically or should a foreigner submit any documents to the ministry?
“Already from the very name of permanent residence it follows that it is given not for a short period, but for a long period. At its prolongation it is only a matter of extending the validity of the document in which it is fixed. The exception is cases where the Ministry knows the reasons that do not permit the extension of the residence permit. But, as a rule, a foreigner is prolonged permanent residence with an automatic device. ”
Vladimir Rzepka lists the most important grounds for depriving an alien of his status as a permanent resident of the Czech Republic.
“For example, in the event that it turns out that a foreigner has received permanent residence fraudulently – through falsification of documents or the falsification of important circumstances. Or when it becomes known that he violated the law in order to obtain a residence permit in the Czech Republic: his marriage was fictitious or he gave himself up as the father of a Czech citizen. Or, provided that the foreigner has repeatedly seriously violated the public order, the rights and freedoms of other citizens or could pose a threat to the Czech state. Another possible option – a foreigner was sentenced by the Czech court for an intentional crime to imprisonment for more than 3 years. ”
– But the outstanding penalties or indebtedness for payment of medical insurance – this is a sufficient reason for the deprivation of a foreigner PERMANENT RESIDENCE?
“For these reasons, you can not deprive permanent residence, but, for example, the repeated confession of an alien guilty of committing crimes – causing harm to a person’s health or committing violent actions against a group of citizens, is already a sufficient basis. That is, it is always necessary to repeatedly violate the law. It should be noted that the deprivation of a permanent residence permit is always made taking into account the circumstances of the foreigner’s private and family life. ”
Photo: European Commission Permanent residence permit imposes certain duties on a foreigner. For example, permanently reside in the Czech Republic. The permanent residence is withdrawn if the foreigner has been out of the EU territory continuously for more than 12 months without valid reasons, or for 6 years did not visit the Czech Republic. The question arises: how does the Ministry of Internal Affairs calculate the period of the absence of a foreign citizen, not only in the Czech Republic, but also in the European Union? Says Vladimir Rzepka.
“The Ministry of the Interior can determine the period of the foreigner’s stay abroad on the marks and visas in his passport. We also use an information database in which there are data on the entry and exit of an alien from the EU. Information from our diplomatic missions is also used. In addition, an interview is conducted with foreigners, during which the necessary information is found out. ”
– And at what point is the verification of whether the alien’s stay was prolonged beyond the borders of the Czech Republic?
“One possibility is when the foreigner extends his residence permit, or earlier, when there are suspicions that the foreigner has not been in the Czech Republic for too long.”
Photo: European Commission As Larisa Lukina, the owner of one of the Prague companies that provide foreigners with assistance in obtaining Czech visas, recently said, the Czech embassies began to monitor more actively whether foreigners with a temporary residence permit are actually in the Czech Republic. This is Article 42a of the Law on the Stay of Aliens, which regulates the issuance of residence permit for the purpose of family reunification. The new version of the law requires a foreigner to stay in the Czech Republic for at least 6 months out of 2 years. Those who stay in the country for a shorter period of time, residence permits began to be selected.
“People who came to the embassies of the Czech Republic were deprived of their residence permits – we had such cases in Moscow and Minsk – they came to their business, for example, to assure the signature of a Czech notary or even a Czech language course. They took their passports, copied all the pages. Then a request was made and it was calculated what time the foreigner was in the Czech Republic. The embassy believes that since the alien is not in the territory of the Czech Republic, he does not need a visa. We turned to the police and we were told that these are the first swallows, there will be hundreds of such cases. ”

– Is there any statistics concerning the deprivation of foreigners permanent residence?

In 200 cases it is a question of deprivation of permanent residence at the request of the foreigners themselves, in other cases there are violations of the law On the stay of foreigners. The most frequent reasons for the withdrawal of a permanent residence permit on the initiative of state bodies are the violation of public order by foreigners, their exceeding of the prescribed period of stay outside the country and the identification of fictitious marriages or a false entry in the birth certificate of the child. In half the cases, the permanent residence has already been terminated. ”
– You can say that recently the number of people deprived of permanent residence is growing?
“The Ministry of the Interior issues a permanent residence on 1 January 2009, so we only have data for this period. Over the past two years, the number of such aliens is about the same. ”
– What explains the cases of voluntary refusal from a permanent residence permit?
“The law does not prescribe to foreigners who want to give up permanent residence, to name the reasons for their decision. But if they already call them, then most often the reason is returning to their home country or moving to another EU country. ”
– How does involuntary deprivation of permanent residence in practice take place? Do people leave the country?
“The Ministry in case of cancellation of permanent residence fixes the period for the departure of an alien from the country, and he is obliged to leave the Czech Republic by this time. If a foreigner wants to file a petition for a new visa, he must do so at the diplomatic mission in his country. ”
